Saagar is wrong about the VRA and proof of discriminatory intent.
Right now, in Louisiana, exactly 2% of black voters are registered Republicans. Any redrawing of maps in favor of Republicans necessarily will cause a disparate impact on black voters. If Republicans had changed their platform in any way to appeal to black voters, so some reasonable number of black voters were Republican (30%?), then the impact would not be so clear.
In discrimination case law, for something like 50 years now, there is what is called "burden shifting" in disparate impact cases. What that means is, if you are a person alleging racial discrimination, and you can show disparate impact, the burden shifts to the accused to prove they did not act for a discriminatory purpose. This burden shifting is exactly because it is very difficult to find a "smoking gun" (like a tape of a congressman saying out loud "we can get rid of these blacks in my district if we do X." ) In 1986 the Supreme Court unanimously confirmed that framework in regard to voting rights. That includes the most legendary of all conservative justices, William Rehnquist.
In essence, while intent still matters, its up to the accused to prove their intent was a lawful one. That has been the law of the land for a very long time. The dissenters in the current case make it very clear that "partisan" in Louisiana means the same thing as "race based."
