Right now, in Louisiana, exactly 2% of black voters are registered Republicans. Any redrawing of maps in favor of Republicans necessarily will cause a disparate impact on black voters. If Republicans had changed their platform in any way to appeal to black voters, so some reasonable number of black voters were Republican (30%?), then the impact would not be so clear.

In discrimination case law, for something like 50 years now, there is what is called "burden shifting" in disparate impact cases. What that means is, if you are a person alleging racial discrimination, and you can show disparate impact, the burden shifts to the accused to prove they did not act for a discriminatory purpose.
