Right now, in Louisiana, exactly 2% of black voters are registered Republicans. Any redrawing of maps in favor of Republicans necessarily will cause a disparate impact on black voters. In discrimination case law, for something like 50 years now, there is what is called "burden shifting" in disparate impact cases.
